a. The owner, tenant, and their respective agent, shall be jointly and <br />severely responsible for the maintenance of all landscaping in a condition presenting a healthy, <br />neat, and orderly appearance free from refuse and debris. On a continuing basis, all dead and /or <br />missing plants must be replaced. <br />7. No trees or plantings other than sod shall be placed in the public right -of -way, <br />except by the governing jurisdiction. <br />8. In all zoning districts, all yards not surfaced for driveway or parking shall be <br />landscaped according to the approved plan prior to the issuance of an occupancy permit or a <br />financial security, as determined by the City Building Official, shall be posted with the City to <br />assure completion of such work. <br />9. Where any business or industrial use abuts property zoned for residential use, <br />the business or industry shall provide screening along the boundary of the residentially zoned <br />property in accordance with this ordinance. A similar screen shall be provided by a multiple <br />family residential project where a multiple family residential use abuts property zoned for single <br />family residential use. <br />10. Parking Lot Landscaping. <br />a. Off - street parking facilities of five (5) or more spaces and all loading <br />facilities shall be fully screened from abutting residential property and public rights -of -way to a <br />minimum height of three and one -half (3 1/2) feet for parking areas and six (6) feet for loading <br />areas. <br />b. Within off - street parking areas of fifty (50) or more stalls, irrigated, <br />landscaped islands shall be provided at a rate of one island per fifteen (15) surface spaces or <br />fraction thereof. For the purposes of this ordinance, an island shall be required to consist of one <br />hundred (100) square feet of landscaped surface. Such islands shall be contained in raised, <br />curbed beds consistent with parking lot construction requirements of this ordinance except that <br />infiltration basins and rain - gardens may be allowed in appropriate locations`. It is not the intent of <br />this paragraph to relieve a project of the installation of islands which are necessary to promote <br />the safe and efficient flow of traffic, regardless of parking lot size. <br />11. Significant Tree Preservation and Replacement. <br />a. Existing Trees. With respect to existing trees in new developments, all <br />trees on the site are to be saved which do not have to be removed for street, buildings, utilities, or <br />drainage : . Trees over six (6) inches in diameter that are to remain <br />are to be marked with a red band and to be protected with snow fences or other suitable <br />enclosure prior to any excavation. The City may further require that the developer retain a <br />professional forester to prepare a forest inventory and management plan for the development, in <br />order to control and abate any existing or potential shade tree disease. Prior to construction, the <br />developer or contractor shall schedule an on -site inspection with the Building Official to identify <br />significant trees to be removed. Significant trees shall be defined as those existing trees of six (6) <br />caliper inches or more, as measured ene feet five feet above the existing grade level. All such <br />trees to be removed to accommodate the project shall be tagged and catalogued by size. The <br />landscape plan shall be required to show replacement of the lost significant trees on a 100 <br />percent caliper inch basis, up to a maximum 30 caliper inches per acre of aggregate disturbed <br />area. <br />H. Traffic Visibility. On corner lots in all districts, no structure or planting in excess of <br />thirty (30) inches above the street center line grade shall be permitted within a triangular area <br />defined as follows: beginning at the intersection of the projected property lines of two <br />intersecting streets, thence thirty (30) feet along one property line, thence diagonally to a point <br />thirty (30) feet from the point of beginning. <br />- 6 9 - <br />
