MINUTES <br />CITY COUNCIL <br />DECEMBER 21, 2011 <br />inspection fee. The fee was to be set at $100 for any inspections after the initial <br />inspection and the first re- inspection. The Administrator reported that the <br />ordinance before the Council was prepared by the City Attorney. Upon <br />adoption of the Ordinance, it will become part of the City's Municipal Code, <br />and the fire re- inspection fee will become part of the City's fee schedule. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011-12-247 — ADOPTING AN ORDINANCE <br />ESTABLISHING A FEE FOR RE- INSPECTIONS OF PROPERTY <br />WITHIN THE CITY OF LITTLE CANADA FOR COMPLIANCE WITH <br />THE FIRE CODE, AND AMENDING THE CITY FEE SCHEDULE TO <br />ADD A FIRE RE- INSPECTION FEE OF $100 FOR INSPECTIONS <br />AFTER THE INITIAL FIRE INSPECTION AND FIRST RE- INSPECTION <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />PUD The City Administrator noted that in 2010 the City approved a PUD to allow <br />AGREEMENT construction of a three -car garage structure at Heritage Office Park. As part <br />FOR of that approval, the City Planner recommended that a PUD Agreement be <br />HERITAGE recorded against the property to govern future sale and /or use of the individual <br />OFFICE garage stalls given that each garage stall will be owned independently by one of <br />PARK the office condo owners. The Administrator reported that the City Attorney has <br />GARAGE now prepared the PUD Agreement incorporating the City Planner's <br />recommendations. That Agreement indicates that each individual garage stall is <br />tied to a specific Heritage Office Park business unit, and cannot be sold <br />independently of the business unit. <br />Blesener asked about maintenance of the garages. The City Administrator <br />indicated that maintenance issues would be governed by the association <br />documents. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -12 -248 — APPROVING THE PUD AGREEMENT <br />WITH HERITAGE OFFICE PARK RELATIVE TO GARAGE STRUCTURE <br />ON THIS PROPERTY AS RECOMMENDED BY THE CITY PLANNER <br />AND PREPARED BY THE CITY ATTORNEY AND AUTHORIZING THE <br />MAYOR AND CITY ADMINISTRATOR TO EXECUTE ON BEHALF OF <br />THE CITY <br />9 <br />
