MINUTES <br />CITY COUNCIL <br />DECEMBER 21, 2011 <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />USE The City Administrator reported that the property at 2572 Edgerton Street <br />AGREEMENT initially was developed with a small cottage. In the 1980's the property was <br />FOR 2572 sold to a family member who constructed a single- family house on it. At that <br />EDGERTON time the Council entered into an agreement with the property owner which <br />STREET required that the cottage be either removed from the property or converted into a <br />boat house when the occupant at the time ceased to occupy the cottage. The <br />cottage would then no longer be able to be used as a dwelling unit. <br />The Administrator reported that the property at 2572 Edgerton Street has been <br />purchased by the adjacent property owner. It is his desire to utilize the boat <br />house structure for a recreational building, but not a dwelling unit. The <br />Administrator reported that the new State Law allows for the rehabilitation of <br />non - conforming structures, but that Law would not allow the structure to again <br />be occupied as a dwelling unit. <br />The Administrator stated that the Building Official, City Planner, and City <br />Attorney have reviewed this matter, and an agreement has been prepared by the <br />City Attorney which formalizes the restricted use of the boat house. The City <br />Administrator recommended approval of this agreement as prepared by the City <br />Attorney. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -12 -246 — APPROVING THE USE AGREEMENT <br />FOR 2572 EDGERTON STREET AS PREPARED BY THE CITY <br />ATTORNEY AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE THIS AGREEMENT ON BEHALF OF <br />THE CITY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />FIRE The City Administrator noted that as part of this year's goal setting a goal <br />REINSPECTION was adopted to establish fire re- inspection fees given the difficulties that <br />FEES the Fire Marshal was experiencing with follow -up inspections. The <br />Administrator noted that the Council discussed the issue further at a regular <br />meeting and directed staff to prepare an ordinance establishing a fire re- <br />8 <br />
