MINUTES <br />CITY COUNCIL <br />JANUARY 23, 2012 <br />residential properties. The City Administrator noted that the assessment is <br />based on footage at the residential rate given that the Edgewater <br />Townoffices do not have direct access to Park Street. The Administrator <br />noted that the City has assessed similar situations and had that assessment <br />level upheld in court. DuBay felt the assessment was somewhat <br />aggressive to him. The Administrator noted that the assessment is only an <br />estimate at this time, and suggested that if the project moves forward, the <br />assessment can be reviewed to ensure it is equitable. He noted that the <br />assessment estimate is based on the City's Assessment Policy which may <br />not address all situations perfectly. <br />There were no additional comments from the general public. <br />Upon motion by McGraw, seconded by Keis, the public hearing was <br />closed. <br />Blesener noted that there were six Park Street property owners present and <br />on a show of hands three indicated their support for the project. The <br />Engineer noted that if the project does not move forward this evening, it is <br />likely that it would be proposed again in 2 years. The City Administrator <br />recommended that the project move forward and bids be obtained. If the <br />bids are over estimate, the Council can reject the bids and delay the <br />project. If delayed, the City Administrator recommended that the <br />improvement be proposed again in one year given the current condition of <br />the street. <br />Schultz indicated that he preferred the project to move forward at this <br />tine, rather than have it delayed and the cost increase. The City <br />Administrator was hopeful that the bidding market would be competitive <br />and the City would obtain good pricing. He noted, however, that many <br />contractors did not survive the last few years, so the market has thinned <br />out. The Administrator indicated the City can inform property owners <br />when the bids are going to be reviewed by the Council so that they can <br />provide their input on the decision of whether or not to award the bid. <br />Blesener agreed that the project should move forward to the next step <br />obtaining bids for the work. Property owners would be informed of the <br />Council meeting at which bids would be considered. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -1 -15 - ORDERING IMPROVEMENT NO. <br />2012 -01, PARK STREET FROM COUNTY ROAD C TO DEMONT <br />STREET, AND AUTHORIZING THE CITY ENGINEER TO <br />5 <br />
