MINUTES <br />CITY COUNCIL <br />DECEMBER 17, 2025 <br />Malone agreed and stated that they want to have these regulations not just for now but for the future as <br />well. <br />Gutierrez asked if there is an urgency to vote on this tonight. Mayor Fischer stated that he did not <br />believe there was urgency, but also did not believe there was anything that would change his views, as <br />he and Gutierrez will disagree on a few points she has brought up. <br />Gutierrez stated that she would be more comfortable having the opportunity for additional discussion <br />with the City Attorney before voting on this item. She stated that there are emails that have been <br />received from residents related to the inspection laws. The City Attorney stated that the ordinance <br />would require a business to cooperate during business hours if an inspection is requested. She noted <br />that this is not unique to this ordinance or type of business. She stated that from a legal perspective, <br />she always provides the direction that the City has the right to an inspection and the individual has the <br />right to say they must leave the property. She stated that if that were to happen, the city would gain an <br />administrative warrant to complete the inspection. <br />Gutierrez stated that she does not understand how a bed is more problematic than any other surface and <br />asked the Council to reconsider that, as that is the most appropriate surface for many types of services <br />and creates a better safety situation for practitioners and clients. <br />Mayor Fischer stated that he is very concerned about activities that are not part of the plan and rules <br />can be broken. He stated that the bad actor could be a customer, and specifically for the business <br />tonight, the proprietor works hard and will be successful with the rules that are being put in place, <br />recognizing that it might require adaptation. <br />Upon motion by Gutierrez, seconded by Miller, table this item for additional discussion. <br />Ayes (2) (Gutierrez and Miller). Nays (3). Motion failed. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2025-12-192 — ADOPTING ORDINANCE 912, AMENDING <br />CHAPTERS 2202 AND 2203 OF THE CITY CODE TO REGULATE NON -MASSAGE <br />TOUCH -BASED COMPLEMENTARY AND ALTERNATIVE HEALTHCARE <br />PRA CTICES IN A MANNER CONSISTENT WITH LEGITIMA TE PUBLIC HEALTH, <br />SAFETY, AND WELFARE OBJECTIVES AND APPROVING SUMMARY <br />PUBLICATION OF THE ORDINANCE <br />The foregoing resolution was duly seconded by Malone. <br />Ayes (3). Nays (2) (Gutierrez and Miller).
