MINUTES <br />CITY COUNCIL <br />DECEMBER 17, 2025 <br />Mayor Fischer recognized the work that the Assistant Fire Chief has done in this role and thanked him <br />for his service. He also thanked the Fire Department for its service to the community. <br />PUBLIC BEARINGS <br />ORDINANCES 922-926, AMENDING THE ZONING CODE RELATING TO ACCESSORY <br />STRUCTURES AND ACCESSORY BUILDING STANDARDS <br />The Community Development Director presented proposed changes to ordinances 922 to 926 centered <br />around accessory buildings and structures. He provided background information on the Code updates <br />that have been made throughout 2025 and the review that has occurred on these ordinances throughout <br />2025. He reviewed the new definitions and the other proposed changes to attached garages, detached <br />accessory buildings, Conditional Use Permit (CUP) policies, accessory dwelling units (ADUs), <br />exterior materials, and height. He recommended approval as presented. <br />Mayor Fischer opened the public hearing for comments from the general public. <br />Mike Mui, 2973 Payne Avenue, asked about the rationale behind not allowing short-term rentals of <br />ADUs. <br />The Community Development Director stated that was discussed by both the City Council and <br />Planning Commission, noting that it is always easier to remove restrictions than it is to add them in the <br />future. He explained that the thought process was to start more restrictive and if no issues arise, that <br />restriction could be removed in the future. <br />There were no further comments from the public. Upon motion by Miller, seconded by Kwapick, the <br />public hearing was closed. Ayes (5). Nays (0). Motion adopted. <br />Miller recognized that there has been a lot of discussion to get to this point and appreciated the time <br />and effort that has gone into this. <br />Gutierrez stated that throughout the discussions, she expressed some concern with the requirement for <br />owner occupancy for an ADU. She stated that she did not see any reason that requirement would be <br />needed but agreed that it needed to be included in order to move it forward. She stated that if someone <br />wanted to rent out both the primary home and ADU, they should bring that forward to the city. <br />The Community Development Director stated that input from residents was used to draft the ordinance <br />in the scope presented. He stated that the city is always receptive to resident input. <br />Malone commented that she has appreciated the review and input that have been provided throughout <br />the process by the Council, staff, and Planning Commission to create something that is easy to <br />understand and apply. <br />Kwapick thanked staff for drafting this, noting the intention to streamline the ordinances into <br />something that is easy for anyone to understand and for staff to apply. <br />0 <br />
