median between two 32 foot driveways, which the applicant did not build. The present <br />condition is a wide street access, approximately 100 feet in width. Maximum width for <br />curb cuts, as established in the Zoning Ordinance, is 24 feet, with a minimum of 40 feet <br />between curb cuts. The Zoning Ordinance also allows one curb cut allowed per 125 feet <br />of frontage. <br />CUP Amendment. The applicant has requested an amendment to a Conditional Use <br />Permit to revise parking on the site. In the previously approved CUP, parking is <br />provided in two areas- a seven stall area off of Ryan Lane and a four stall area off <br />Spruce Street. The applicant wishes to revise this to provide four stalls in the current <br />seven stall area, and seven stalls in the area designated for four stalls. <br />The parking design proposed by the applicant does not meet city requirements. The <br />Zoning Ordinance requires curbing and landscaping of parking areas, including a <br />continuous curb barrier around the parking area no closer than five feet to any property <br />line. Additionally, no parking may occur in the right -of -way or within 15 feet of the street <br />surface. <br />The applicant must meet city requirements for parking setbacks and curbing. The <br />proposed parking is directly on the property line. Moreover, it appears that some of the <br />parking will interfere with garage access and circulation for other parking. The applicant <br />should revise the site plan to meet Zoning Code requirements, including setback, green <br />space, and circulation. A minimum of 11 spaces must be provided, and may be located <br />in approved and paved parking lots that conform to the city's Zoning Ordinance <br />Requirements. <br />ALTERNATE ACTIONS <br />The applicant proposes to reconfigure parking in a manner that violates the Little <br />Canada Zoning Ordinance. While the applicant may revise the CUP to allow alternate <br />parking locations, the current request cannot be accommodated due to the non- <br />conforming location proposed for stalls 6 and 7 on the applicant's site plan. <br />For these reasons, the Planning Commission and City Council may deny the request to <br />amend the CUP on the property. <br />Alternatively, the parking layout offers flexibility to the business, and could be amended <br />to provide parking areas that meet Zoning Ordinance requirements. For these reasons, <br />the Planning Commission and City Council may approve the request, subject to the <br />following conditions: <br />1. The applicant shall relocate stalls 6 and 7 on the plans submitted to the city, <br />dated June 23, 2006 to conform to requirements of the Little Canada Zoning <br />Ordinance. <br />2. Revised parking may not take place within 15 feet of the street surface, 5 feet of <br />the property line, or within boulevard areas. <br />2 <br />
