• No more than two (2) massage therapist individual licenses will be issued to any <br />business establishment. <br />Comment: The applicant is proposing three massage therapists on the site. A text <br />amendment to Section 2202 of the City Code of Ordinances is being considered at this <br />time. This amendment would allow massage therapy as a principal use to license up to <br />three therapists at a time. Any recommendation of approval for this application is <br />subject to the approval of this amendment. <br />• Licenses may be denied or rescinded if the premises of the establishments do <br />not meet the requirements of the City Council, and of the building, safety and <br />sanitation regulations of the City of Little Canada, and State of Minnesota. <br />• Licenses may be denied or rescinded if there is any fraud or deception involved <br />in the license application. <br />• Licenses may be denied or rescinded if the applicant, licensee or employee of <br />the same fail to comply with, or have a history of violations of the laws or <br />ordinances which apply to health, safety, or moral turpitude. <br />• The City Council may attach such reasonable conditions to the license as it, in its <br />sole discretion, deems to be appropriate. <br />• The City may run criminal history checks on any applicant for a license pursuant <br />to this chapter. <br />• A license for massage therapy shall be reviewed annually. No license approved <br />by the City grants the licensee a property right or entitlement to a license. The <br />City Council may refuse to issue, refuse to renew, or may suspend or revoke a <br />license for any reason, and the City will not incur liability for any damages <br />including, but not limited to, direct, consequential, or incidental damages, <br />deprivation of property, loss of income, loss of profits, or loss of livelihood. <br />Parking. The parking requirement for office buildings, clinics, and professional offices <br />is three spaces, plus one space for each 200 square feet of gross floor area. The <br />proposed use would fall under this category. The office is approxirpately 1,060 square <br />feet, requiring eight spaces (1,060x.9)1200) =5). According to a narrative submitted by <br />the applicant, each unit in the Edgewater Office Park is allotted six parking stalls. <br />However, a total of 90 parking stalls are available on site. <br />Only two therapists will be scheduled to work at one time, each able to service one <br />client. It is anticipated that the client for the next scheduled appointment will be arriving <br />prior to the first client leaving the site. This type of activity would require six parking <br />stalls. <br />The hours of operation are from 9:00 am to 7 :00 pm Monday through Friday, and <br />Saturday from 10:00 am to 5:00 pm.
