Alternative Actions Regarding the application for a Conditional Use Permit for massage therapy in the B -3 District, the City has the following options: 1. Motion to approve the Conditional Use Permit, based on a finding that the proposed use meets the conditions of approval and may be adequately served by the proposed location. 2. Motion to deny the Conditional Use Permit, based on a finding that the conditions for approval and /or licensing requirements have not been met. Summary and Recommendation The Zoning Ordinance contains provisions for allowing the proposed use in the B -3 District and the use appears to meet the conditions of approval. The available parking appears to be adequate, and peak periods are complimented by operating hours of the surrounding businesses. However, the proposed number of therapists exceeds the maximum number of licenses allowed by City Code. A corresponding text amendment to allow three massage therapy licenses for one individual business is being considered at the time of this application. All massage therapists must be licensed in order to practice within the City. Staff recommends approval of the proposed use, contingent on the approval of this text amendment.
