MINUTES CITY COUNCIL JUNE 28, 2006 ALLOWING FOR DEALER PREP AND ASSEMBLY AT THIS LOCATION The foregoing resolution was duly seconded by Keis. Ayes (4). Nays (0). Resolution declared adopted. IxJLIC ? Blesener opened the Public Hearing to consider the revocation of A iNd Conditional Use Permits for Fred Sedaghat, Valor Enterprises, at 3161, 3165, 3167 Spruce Street. It was noted that the Planning Commission has CONSIDER recommended in favor of revocation. REVOCATION OF CUP'S " The City Administrator reported that Conditional Use Permits for Valor VALOR' ` Enterprises were issued in 1999 for open and outdoor storage and in 2000 ESITERPRgSES for retail auto sales. The Administrator noted that both CUP approvals were subject to conditions related to limitations on numbers of vehicles, as well as paving, parking, and landscaping. The City Administrator reported that compliance with these conditions has been a problem from the onset. He further reported that Mr. Sedaghat has claimed there are drainage problems beyond his site that have prevented compliance as well as other problems such as economic conditions and his inability to find qualified staff. The City Administrator provided a detailed timeline relative to violations and the City's code enforcement efforts with this property. He noted that at times the property has been brought close to compliance, but always reverts back to non - compliance status. Most recently in 2005, giving the pending renewal of auto licenses, the property was brought fairly close to compliance at the 11th hour. At that time, Mr. Sedaghat temporarily moved cars off his property and then brought them back once the auto licenses were issued. The City Administrator reviewed photos of the Valor site that were taken in April, 2006 which reflect extremely poor site conditions. He then presented pictures take late this afternoon which show that Mr. Sedaghat has made efforts to clean up the property. It was noted, however, that there is still a great deal of clean up which will have to occur to bring this property into compliance. The Administrator reported that Mr. Sedaghat is requesting that the City grant him six months to bring his property into full compliance. Blesener asked Mr. Sedaghat why he allows junk to accumulate on his property and why he does not get rid of it. Blesener noted that from the photos shown, the vehicles stored on the property are junk and are not 12
