£ There shall be no storage of hazardous materials, as defined by the zoning <br />ordinance Section 902 of this Ordinance, within any such container. <br />The applicant is not requesting any changes to this requirement and the <br />conditions approved in 2008 are still in effect. <br />7. .Outdoor storage areas must be kept in an orderly condition, permitting vehicular <br />access to all materials or equipment. Lanes at least twenty (20) feet in width shall <br />be required to meet this standard. No portion of the outdoor storage shall be more <br />than fifty (50) feet from any access lane or other drive aisle, nor shall it block <br />access to hydrants, fire sprinklers, or other fire- fighting equipment. Access needs <br />to be clear and maintained. <br />8. Except for construction equipment which is stored or parked in its most compact <br />condition, outdoor storage may not exceed eight (8) feet in height as measured <br />from the ground on which it is Located. Storage on top of the storage container in <br />the rear yard will need to be removed. Otherwise, the other equipment and /or <br />materials on the property comply with this provision. <br />9. The storage area shall he fenced and fully screened from adjoining non- industrial <br />property, park and trail areas, and public right of way. Where properly fenced <br />and screened, outdoor storage may encroach into the required side or rear yard <br />setback area. Gates may be excluded from this screening requirement as provided <br />for in Section 903.020.0.6. Landscaping already exists on the east and west side <br />of the property to screen the side yard storage areas. However, the west side <br />screening is in need of attention. <br />10. Screening shall consist of masonry walls or fencing constructed of wood or vinyl, <br />as well as landscaping. Metal fencing may be used where landscaping provides a <br />complete year -round screen and is irrigated to ensure survivability in compliance <br />with Section 903.020.E (Fences) of this Ordinance. See above comments. <br />11. Waste or recyclable material shall he contained in a refuse container. All such <br />containers shall be stored within a screened enclosure within the rear yard of the <br />property. The applicant is not proposing any changes. Both containers are <br />located in the side yard of the property. <br />12. The storage area shall be paved with asphalt, concrete, or other material approved <br />by the City Council. The storage areas are a combination of paved and gravel, <br />consistent with this requirement. <br />13. The storage area shall not occupy any space required for conformity to the <br />parking regulations of the Zoning Ordinance. Based on the site plan submitted, <br />the trailer appears to limit access to four (4) of the required parking spaces. <br />The CUP issued in 1999 required 16 parking spaces on the property. Those <br />spaces are established on the site and are itt compliance with city codes. <br />However, since 1999 some of the uses inside the building have changed and <br />based on the current renters 21 parking spaces would be required. It would be <br />staff's recommendation that the property owner enter into an agreement with <br />the City for Proof of Parking on the site. An updated site plan was submitted <br />showing evidence of ability to construct five (5) additional spaces on the <br />property at some future date in compliance with zoning and building code <br />standards should the need arise. These five (5) additional spaces, plus the four <br />(4) being obstructed by the trailer would be used in the Proof of Parking with <br />the 12 remaining parking spaces being sufficient at this time. <br />4 <br />
