Under this standard, the applicant no longer has to show that the ordinance prohibits any <br />reasonable use, only that his /her request is using the property reasonably. The following are <br />staff's findings of fact for variance approval: <br />1. Outdoor storage is currently approved up to the 40 foot front yard setback on both side <br />yards of the property. This trailer is proposed to be setback 40 feet from the front yard <br />property line. That is consistent with the previously approved CUP for this property. <br />2. Granting of this variance is consistent with the Comprehensive Plan and zoning <br />ordinance. <br />3. Relocation of the trailer is not practical due to security or maneuverability issues on the <br />site clue to the irregular shape and shallowness of the lot which are unusual for an <br />industrial lot. <br />4. This site has a limited rear yard due to its shallowness which makes storage in this area <br />impossible. <br />5. Granting of this variance will not alter the essential character of the locality. <br />Based on the above findings of fact, city staff recommends granting a variance for 209 <br />Ryan Drive to allow outdoor storage of one (1) racing utility trailer (not to exceed 48 feet <br />long and 9 feet tall) annually from April 15th to October 15" with storage allowed between <br />the front line of the building and public street, but in no case within the 40 foot front yard <br />setback. <br />in addition, city staff recommends the Planning Commission recommend approval of a <br />Conditional Use Permit for Proof of Parking at 209 Ryan Drive. <br />Should the Planning Commission choose to recommend denial of the variance for 209 Ryan <br />Drive, the reason for denial would he that there was no basis for the finds of fact listed above. <br />6 <br />
