Failure by the Contractor to notify <br />the City to make any upward adjustments in the allotted time frame shall not be applied <br />retroactively. <br />** Gene's Disposal Customer will remain at $2.00 per month for weekly, two sort recyclables <br />collection. In this instance, any applicable fuel surcharge fee will be applied against this amount as <br />well. <br />** *The Fuel Surcharge Fee is based on Attachment "C" and is not eligible for application to this <br />contract until January 1, 2010 based on Midwest No. 2 diesel prices at that time. After January 1, <br />2010, the Fuel Surcharge shall be adjusted quarterly using Attachment "C" pursuant to Contract <br />Provision E.3.
