ARTICLE 3 <br />SECTION 3.01. Ownership of Facilities Transferred from Little Canada to Board <br />Upon the Effective Date of this Agreement, all rights, title and interest to the following <br />supply and metering facilities lying within Board -owned property up- stream of the County Road B <br />Point(s) of Delivery, as shown on Attachment A, shall be transfer from Little Canada to the Board: <br />➢ Water supply mains, valves and other appurtenances. <br />➢ The building that houses the Master Meter(s). <br />ARTICLE 4 <br />SECTION 4.01. Water System Facilities - Board <br />A. The Board shall make investment in, construct, maintain, fmance, operate, repair, replace <br />and retain title to all facilities necessary for the supply, metering, production, storage and <br />transmission of water to the Point(s) of Delivery of wholesale water to Little Canada. All <br />such facilities of the Board shall comply with and conform to the relevant Minnesota State <br />Health Department and other applicable health or safety requirements <br />B. Water delivered to Little Canada shall be measured by a Master Meter or Meters <br />furnished, installed and maintained by the Board at its own expense at a location <br />mutually agreeable to both parties. Monthly billings to Little Canada shall be based on <br />the readings of the Board's Master Meter(s). The Board shall make records of its master <br />meter maintenance available to Little Canada upon request. The Board shall test the <br />Board's Master Meter(s) annually and those test results provided to Little Canada. The <br />Board shall provide Little Canada with advance notice of the Master Meter testing date in <br />order to afford a Little Canada representative the opportunity to attend the test.
