Little Canada shall deliver to the Board a list of those addresses read, plus the meter <br />reading and date of reading. <br />C. Carla Lane Fire Hydrant Usage. <br />Along with the above - described list for Carla Lane Metered Water Usage, Little Canada <br />shall provide to the Board a list of its Carla Lane hydrant use. The list shall include date <br />and duration of use for each hydrant operated during the submitted time period. <br />SECTION 7.03 Billing and Payment <br />Billings by the Board shall be mailed to Little Canada 011 or before the 10th day of the <br />following month (the `Billing Date ") and payment on such bills shall be made by Little <br />Canada to the Board within 20 days from the Billing Date. Balances that remain unpaid after <br />thirty (30) days shall be subject to a 1% per month late charge; this charge will be added to <br />the next monthly billing. <br />ARTICLE 8 <br />SECTION 8.01. Liability and Indemnification <br />Each party agrees that it shall be responsible for its own acts and omissions and the results <br />thereof to the extent authorized by law and shall not be responsible for the acts and omissions of the <br />other party and the results thereof. The liability of the parties shall be governed by and limited to the <br />tort liability provisions found in Minnesota Statutes Chapter 466, as amended from time to time, and <br />any other applicable law, notwithstanding the foregoing. This section shall survive any termination <br />of this Agreement. <br />SECTION 8.02. Default <br />A. In the event one party defaults on a material term or condition of this Agreement, the <br />other party shall provide written notice of said default to the defaulting party.
