MINUTES <br />CITY COUNCIL <br />OCTOBER 11, 2006 <br />CALL FOR <br />HEARING — <br />VACATION <br />OF PORTION <br />OF COUNTRY <br />DRIVE <br />RIGHT- OF-WAY <br />Keis noted that this problem was caused by development outside the RCC <br />property, and asked how the City will ensure that drainage impacts from <br />future projects do not result in this problem in the future. <br />The City Administrator indicated that the City Engineer at the time, felt <br />that the City's motivation was to get a project developed, and as a result <br />did not take a tougher stance on the drainage from this project which <br />impacted the RCC property. The City Administrator felt that the practices <br />of the current City Engineer are far more diligent and that drainage <br />impacts to surrounding properties are a consideration in his project <br />drainage reviews. <br />Keis noted that if this drainage had been addressed in the original project, <br />the City would not be faced with correcting this problem years later. The <br />City Administrator replied that that was correct. He noted that the City <br />does not want to have to pay to correct drainage problems which should be <br />the responsibility of a developer at the time of development. <br />Montour asked the age of RCC's parking lot. Crownhart estimated the <br />age at 12 to 15 years. She noted that the parking lot is in excellent <br />condition except for some minor areas. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006 -10 -238 — AUTHORIZING THE CITY <br />ENGINEER TO PREPARE PLANS AND SPECS FOR THE <br />RESOURCES FOR CHILD CARING DRAINAGE PROJECT, AND <br />INDICATING THAT THE CITY'S INTENTION IS TO BID THIS <br />PROJECT AS PART OF THE 2007 IMPROVEMENTS <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that RAB, LLC would like to place a <br />monument sign at their new building located at 2935 Country Drive. <br />Given the extra wide right -of -way for Country Drive, the property owner <br />does not have adequate room between the curb line and the right -of -way <br />to install their sign. The Administrator reported that staff has reviewed <br />this matter and believes a portion of the Country Drive right -of -way can <br />be vacated to accommodate the sign, while leaving the City in excess of <br />60 feet of right -of -way. The proposal would be to vacate approximately <br />11 feet of Country Drive as abuts 2935 Country Drive. <br />5 <br />
