MINUTES <br />CITY COUNCIL <br />OCTOBER 11, 2006 <br />Allan noted that it appears if the sign were placed to face east and west <br />there would be no need for the vacation. She noted that signage for the <br />Kandice Heights projects face east and west. <br />The City Administrator reported that the City's ordinance requires that <br />signage be at least five feet from the property line. He also noted that <br />RAB, LLC is concerned about visibility for the sign and feels the <br />alignment perpendicular to Country Drive would provide the most <br />visibility. <br />Blesener asked if the proposed vacation is for right -of -way directly in <br />front of 2935 Country Drive. The Administrator replied that it is. <br />Keis noted that the City has a sewer line within this right -of -way, and even <br />though the right -of -way vacation would occur, a sewer easement would be <br />maintained by the City. Keis pointed out that this puts the sign at risk <br />should there be a sewer problem. <br />The City Administrator noted that RAB, LLC would be required to sign an <br />agreement acknowledging the risk to the sign. <br />Keis asked if the City could allow the sign without vacating the right -of- <br />way. The Administrator noted that a Variance would be necessary, given <br />the Code requires signage to be on the business's own property. He also <br />noted that the City would still retain a minimum of 60 -feet of right -of- <br />way, which would be adequate should Country Drive ever be widened. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006 -I0 -239 — CALLING FOR A VACATION <br />HEARING FOR A PORTION OF COUNTRY DRIVE RIGHT-OF- <br />WA Y AS RECOMMENDED BY CITY STAFF TO BE HELD ON <br />WEDNESDAY, OCTOBER 25, 2006 AT 7:30 P.M. <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />COUNCIL The City Clerk proposed that given the Thanksgiving Holiday, the <br />MEETING November 22" d Regular Council Meeting be changed to Monday, <br />DATES November 20th at 7:30 p.m. She further noted that the Council has a <br />Zoning Workshop continuance scheduled for Monday, November 20`x' at <br />4:30 p.m., and recommended that the time be changed to 5:30 p.m. <br />6 <br />
