Hanson <br />All buildings must be classified as to the nearest occupancy they most nearly <br />resemble. The building located at 140 Rose Place was originally constructed and <br />classified as a Group R -3 dwelling occupancy containing two dwelling units. <br />In the 2003 Minnesota State Building Code, Chapter 1341, Section 1341.0100 <br />ADAAG 1: Purpose., Exception 2: Group R -3 dwelling occupancies containing <br />not more than three dwelling units are exempt from the current edition of the <br />Minnesota Accessibility Code. <br />The primary use for the building is to house residents and their belongings and the <br />secondary use is the in home business therefore I do not see any reason to change <br />the buildings classification. If the buildings primary use is the business then its <br />classification would change to a B (business) occupancy, the building itself would <br />be located in an incorrect zoning district, and accessibility for the handicapped <br />would be required. <br />H: \SteveW \Steve 2003 \140 Rose Place- Vasq.doc <br />
