MINUTES <br />CITY COUNCIL <br />SEPTEMBER 27, 2006 <br />Upon motion by Keis, seconded by Montour, the public hearing was <br />closed. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006 -9 -217 — CONTINUING THE PUBLIC <br />HEARING ON THE SPECIAL USE PERMIT FOR A HOME <br />OCCUPATION PROVIDNG SPA SERVICES AS WELL AS A TEXT <br />AMENDMENT TO CHAPTER 2202 RELATIVE TO MASSAGE <br />THERAPY AS AN ACCESSORY USE AS PROPOSED BY MARY <br />VASQUEZ FOR 140 EAST ROSE PLACE UNTIL THE OCTOBER 25, <br />2006 COUNCIL MEETING PENDING RECEIPT OF <br />INFORMATION RELATIVE TO ACCESSIBLITY ISSUES AND <br />PREPARATION OF A PROPOSED TEXT AMENDMENT AS NOTED <br />ABOVE CONTINGENT UPON THE APPLICANT SIGNING A 60- <br />DAY WAIVER, AND IF THE APPLICANT DOES NOT SIGN THE <br />WAIVER THE SPECIAL USE PERMIT AND TEXT AMENDMENT <br />DESCRIBED ABOVE IS HEREBY DENIED BASED ON THE <br />FOLLOWING FINDINGS: <br />o LACK OF INFORMATION ON HANDICAPPED <br />ACCESSIBILITY ISSUES AS WELL AS NO <br />AVAILABILITY OF MASSAGE LICENSES IN A <br />RESIDENTIAL AREA; <br />o THE BUSINESS APPEARS TO BE TOO INTENSE TO <br />LOCATE IN A RESIDENTIAL AREA AND SHOULD <br />BE LOCATED IN A COMMERCIAL AREA; <br />o THE UNCERTAINTY ABOUT THE INTENSITY OF <br />THE BUSINESS GIVEN THE NUMBER OF <br />BUSINESS PROPOSALS THAT HAVE BEEN <br />SUBMITTED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CUP, TEXT Mayor Blesener opened the Public Hearing to consider a Conditional <br />AMENDMENT, Use Permit to operate a massage therapy business as a principal use in <br />& MASSAGE the General Business District as well as a Text Amendment to Chapter <br />LICENSES — 2203 relative to massage therapy as a principal use as requested by <br />2580 RICE Paul These, NouPath Massage, for 2580 Rice Street. Mr. These is <br />STREET — also requesting a Massage Therapy Business License, and Nou Yang <br />NOUPATH is requesting a Massage Therapist License. The City Planner and the <br />MASSAGE Planning Commission has recommended approval of these requests. <br />
