MINUTES <br />CITY COUNCIL <br />MARCH 22, 2006 <br />601 COUNTY <br />ROAD B -2 EAST — <br />MURPHY <br />VARIANCE <br />FOR <br />HORSESHOE <br />DRIVEWAY — <br />601 COUNTY <br />ROAD B -2 EAST — <br />MURPHY <br />Blesener noted that the request of Mike and Heidi Murphy for a Variance <br />to the Code to allow a second curb cut at their property at 601 County <br />Road B -2 East was tabled on December 14, 2005 until this evening's <br />meeting. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006 -3 -67— BRING THE REQUEST FOR A <br />VARIANCE FROM THE CODE TO ALLOW A SECOND CURB CUT <br />AT 601 COUNTY ROAD B -2 EAST BACK TO TABLE AND BEFORE <br />THE COUNCIL FOR CONSIDERATION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Blesener noted that a hardship must be present in order to warrant the <br />granting of a variance. Keis stated that he would consider the need to <br />remove the existing large spruce tree in order to put in a T turnaround a <br />hardship. LaValle also pointed out the safety issue related to backing onto <br />County Road B -2 East given the traffic volumes of motorized, non - <br />motorized, and pedestrian traffic. <br />Allan stated that she felt the same as she did in December, that there was <br />no hardship present and that a T turnaround could be installed rather than <br />allow the second curb cut. <br />There was no one else present wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Allan, the public hearing was <br />closed. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006 -3 -68 — GRANTING A VARIANCE <br />ALLOWING A SECOND DRIVEWAY CURB CUT FOR THE <br />SINGLE - FAMILY PROPERTY AT 601 EAST COUNTY ROAD B -2 AS <br />REQUESTED BY MIKE AND HEIDI MURPHY ON THE BASIS OF <br />THE FOLLOWING CIRCUMSTANCES WHICH ARE UNIQUE TO <br />THIS PROPERTY AND CONSTITUTE A HARDSHIP: <br />8 <br />-10- <br />
