Hanson <br />www.ci.littleicanada.mn.us <br />MEMORANDUM <br />TO: Mr. Kevin Schleif, Vice President <br />Mr. Ward Wollerman, General Manager <br />FROM: Joel Hanson, City Administrator <br />DATE: June 6, 2006 <br />RE: Sidewalk/Utility Easement for 235 East Little Canada Road — The Porter House <br />Pursuant to our recent meeting, I am writing to confirm the conditions the City of Little Canada <br />will agree to in return for your execution of the above referenced easement (easement document <br />and consent from mortgage company are enclosed). The provisions are as follows: <br />• One 10" tree on the east side of your property will be removed. (This tree is located <br />predominately within the existing road right -of -way for Country Drive.) The City will <br />replace the tree based with a 2 %2 to 3 -inch caliper tree that is appropriate for roadside use <br />in Minnesota and of a variety to be designated by The Porter House. <br />• If any other tree(s) die as a result of the installation of the sidewalk on your property <br />within two years from execution of the easement, the City will pay for removal and <br />replace the tree on the same basis as defined in the point above. You will notify us of any <br />such instance and the City will act in a timely manner to comply with this provision. <br />• No contractor equipment or materials will be in your parking lot after 4:00 p.m. (We will <br />try to avoid having them use the parking lot at all.) <br />• Any dirt or materials in the parking lot will also be cleaned by 4:00 p.m. in order that <br />your lot is ready for your use for that evening. <br />• We will restore any disturbed area in a manner consistent with surrounding landscaping <br />from an aesthetics standpoint. <br />• Any damage to your lawn irrigation system will be repaired in a timely manner. <br />•t If either of you have any concerns or questions during construction. you should contact <br />Lyle Splittstoser of Elfering & Associates (our project inspector).
