Evergreen Hills <br />Development Contract <br />easements the City deems appropriate. Developer shall pay all costs relating to the acquisition of <br />the necessary easements, including attorney's fees, costs, appraisals, the cost of the necessary <br />property, and any other special conditions, which Developer shall negotiate with any affected <br />property owner(s). Developer also agrees to reimburse City for any costs associated with the <br />acquisition of the easements including drafting, review and recording. <br />24. Developer shall obtain consents to any required easements as necessary. <br />25. Developer hereby grants City, its agents and employees, a license to enter any of <br />Developer's property to perform all necessary work, maintenance and /or inspections deemed <br />appropriate by the City during the construction of the Required Improvements. The license shall <br />expire after the Required Improvements are installed and approved by the City. <br />Miscellaneous <br />26. The Developer represents that the Plat and Required Improvements will comply <br />with all City, County, Metropolitan, State and Federal laws and regulations, including, but not <br />limited to, subdivision ordinances, zoning ordinances, noise ordinances, and environmental <br />regulations; including wetland impact and mitigation. Developer shall obtain all necessary <br />permits and consents for the Required Improvements including, but not limited to, any permits <br />required by the Minnesota Department of Health for water main extensions, any permits required <br />by the Minnesota Pollution Control Agency for sanitary sewer main extension, any permits <br />required by the Metropolitan Council Waste Water Services Division for connections to sanitary <br />sewer lines, any permits required by the Ramsey - Washington Watershed District for grading and <br />storm water discharge; and any permits or approvals necessary to properly comply with Wetland <br />regulations. Developer shall reimburse the City for any costs or expenses incurred by the City <br />due to the need for any permits or consents, and shall be responsible for compliance with any <br />other requirements imposed by the agencies in question. <br />-7- <br />
