Sec. 13 -8. Notice of Violation. <br />(1) Written Notice. When any violation of this Chapter shall come to the attention of the Enforcement <br />Officer, written notice shall be provided to the licensee or if no license has been issued, notice shall be <br />provided to the owner, operator, or occupant of the premises. Notice shall be by United State mail at the <br />last known address of such person and notice shall also be posted in at least one conspicuous place upon <br />the premises where the violation exists. <br />(2) Time to Correct. The notice shall give the alleged violator a specified number of days, not exceeding <br />thirty days, to correct the violation. The Enforcement Officer shall have the authority to extend the time <br />to correct the violation upon good cause being shown. <br />(3) Prosecution. Prosecution for any violation of this Chapter shall not be commenced unless the notice <br />as provided in this Section has been provided and the cited violation has not been remedied within the <br />time specified. Failure to receive the notice shall not be a defense in any prosecution. <br />(4) Reinspection Fee. A fee shall be charged for all reinspections required because of a violation that is <br />not corrected by the time specified in the written notice. The fee shall be established by resolution.
