MINUTES <br />CITY COUNCIL <br />NOVEMBER 26, 2003 <br />3165/3167 <br />SPRUCE <br />STREET — <br />VALOR <br />AMENDMENT <br />TO ZONING <br />CODE — <br />ACCESSORY <br />& PRINCIPAL <br />BUILDINGS <br />information. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2003 -11 -270 —TABLING ACTION ON THE <br />AMENDMENT TO CONDITIONAL USE PERMIT AND VARIANCE <br />FOR 3165 -3167 SPRUCE STREET, VALOR ENTERPRISES, <br />PENDING A RECOMMENDATION FROM THE PLANNING <br />COMMISSION. <br />The foregoing resolution was duly seconded by LaVaile. <br />Ayes (5) Blesener, LaVaile, Fahey, Montour, Anderson. <br />Nays (0). Resolution declared adopted. <br />Mayor Fahey opened the public hearing to consider an amendment to <br />to the Zoning Code relative to accessory and principal buildings. Fahey <br />noted that the Planning Commission has recommended approval of the <br />amendment. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by Fahey, seconded by Anderson, the public hearing was <br />closed. <br />The City Planner indicated that the proposed amendment clarifies the <br />definitions of accessory use /building, and principal. use building as well as <br />establishes single- family dwelling performance requirements. <br />Mr. LaVaile introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2003-71-277—AMENDING SECTION 902 OF <br />THE LITTLE CANADA CITY CODE ADDRESSING ACCESSORY <br />USE /BUILDING AND PRINCIPAL USE /BUILDING DEFINITIONS <br />AND ESTABLISHING SINGLE - FAMILY DWELLING <br />PERFORMANCE REQUIRE: F.NTS <br />The foregoing resolution was duly seconded by N4ontour. <br />Ayes (5) LaVaile. Montour, Anderson, Blesener, Fahey. <br />Nays (0). Resolution declared adopted. <br />Anderson noted the moratorium that is in place relative to this !natter. The <br />City Attorney noted that the moratorium ordinance contained an <br />expiration date and recommended that it be allowed to expire on its own. <br />
