MINUTES CITY COUNCIL NOVEMBER 26, 2003 3165/3167 SPRUCE STREET — VALOR AMENDMENT TO ZONING CODE — ACCESSORY & PRINCIPAL BUILDINGS information. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 2003 -11 -270 —TABLING ACTION ON THE AMENDMENT TO CONDITIONAL USE PERMIT AND VARIANCE FOR 3165 -3167 SPRUCE STREET, VALOR ENTERPRISES, PENDING A RECOMMENDATION FROM THE PLANNING COMMISSION. The foregoing resolution was duly seconded by LaVaile. Ayes (5) Blesener, LaVaile, Fahey, Montour, Anderson. Nays (0). Resolution declared adopted. Mayor Fahey opened the public hearing to consider an amendment to to the Zoning Code relative to accessory and principal buildings. Fahey noted that the Planning Commission has recommended approval of the amendment. There was no one from the general public present wishing to comment on this matter. Upon motion by Fahey, seconded by Anderson, the public hearing was closed. The City Planner indicated that the proposed amendment clarifies the definitions of accessory use /building, and principal. use building as well as establishes single- family dwelling performance requirements. Mr. LaVaile introduced the following resolution and moved its adoption: RESOLUTION NO. 2003-71-277—AMENDING SECTION 902 OF THE LITTLE CANADA CITY CODE ADDRESSING ACCESSORY USE /BUILDING AND PRINCIPAL USE /BUILDING DEFINITIONS AND ESTABLISHING SINGLE - FAMILY DWELLING PERFORMANCE REQUIRE: F.NTS The foregoing resolution was duly seconded by N4ontour. Ayes (5) LaVaile. Montour, Anderson, Blesener, Fahey. Nays (0). Resolution declared adopted. Anderson noted the moratorium that is in place relative to this !natter. The City Attorney noted that the moratorium ordinance contained an expiration date and recommended that it be allowed to expire on its own.
