driveway off of Labore Road. Staff recommends that the closing of this driveway be <br />permanent. The applicant shall landscape the old driveway to prevent access from <br />Labore Road. Future resubdivision or additional driveway construction would be subject <br />to the processing and regulations applicable to subdivisions and Conditional Use <br />Permits, as appropriate. <br />Regarding other modifications to the site, staff supports the applicant's proposal to <br />remove the existing home and detached garage from 640 Labore Road. In the <br />Comprehensive Plan a list of goals for the east portion of the City is provided. One <br />such goal is to remove substandard housing when the opportunity presents itself. <br />Removing the second home will also bring the combined parcel into compliance, as lots <br />in the R -1 District are only allowed one principal structure. At a minimum, the existing <br />home at 640 Labore Road shall be removed and the driveway shall be closed prior to <br />recording the lot combination. <br />Accessory Structure. In addition the lot combination, the applicant is proposing to <br />construct a "Sports court" in the location of the existing house, once it is removed. Thus, <br />the impervious surface of the site will not be increased. Said court would be an 800 <br />square foot basketball court located in the rear yard of the site, enclosed with a 6 -foot <br />fence. <br />The code allows for swimming pools, tennis courts and other recreational facilities, such <br />as a basketball court, which are operated for the enjoyment and convenience of the <br />residents of the principal use and their guests. Such facilities are regulated as an <br />accessory use in the R -1 District. The applicant is proposing to locate the structure in <br />the rear yard of the property. Accessory buildings, uses and equipment may be located <br />in the rear yard, but must be setback at least ten feet from the rear yard and side yard <br />lot lines. A dimensioned site plan has not been submitted. However, it appears as <br />though the applicant easily meets all setback requirements of the R -1 District. <br />The applicant is proposing to construct a 6 -foot fence surrounding the basketball court. <br />Materials of said fence have not been submitted. However, they will be required to <br />meet the requirements of the ordinance. Planning staff would encourage the applicant <br />to utilize vinyl coated chain link (black or green) to reduce the visual impact of the fence <br />as much as possible. <br />SUMMARY AND RECOMMENDATION <br />The applicant is seeking approval of the Lot Combination, based on a finding that it <br />resulting parcel is consistent with standards of the R -1 District and will have no adverse <br />affect on surrounding properties. Staff would recommend that any approval be made <br />subject to the following conditions: <br />a. The existing home at 640 Labore Avenue shall be removed and the <br />corresponding driveway shall be closed prior to recording the lot combination. <br />2 <br />
