MINUTES <br />CITY COUNCIL <br />JANUARY 25, 2006 <br />o The CUP is non - transferable; <br />o A satisfactory six -month review of the CUP. <br />Brian Meyer, B & B Meyer, LLP, reported that they purchased Coliseum <br />Billiards from Ahmed Alriffi in December, and are planning to run the <br />business in the same way he had. Meyer indicated that the only exception <br />is that he has applied for a 3.2 Intoxicating Malt Liquor License and would <br />like to sell 3.2 beer as Mr. Melloy had when he owned the billiard hall. <br />Keis pointed out that there are two entrances to the back room area where <br />the alcohol sales and consumption would be confined. Meyer reported <br />that one of those doorways would be an out -only. The other would be a <br />controlled entrance to the back room to ensure that only people aged 21 <br />years and older would be allowed in. <br />Montour noted that the previous owner had a 2 a.m. closing time posted, <br />but was allowed to remain open to 4 a.m. if there were customers present. <br />Meyer stated that their plan would be to post the closing time as 2 a.m. If <br />there are customers on site, they would utilize the 4 a.m. closing time. <br />The Mayor asked if there was anyone from the general public present <br />wishing to comment on this matter. There was not. <br />Upon motion by Montour, seconded by Blesener, the public hearing was <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 20064 -15 — APROVING A CONDITIONAL USE <br />PERMIT ALLOWING BILLIARD /AMUSEMENT HALL AS A <br />COMMERCIAL RECREATION USE IN THE PUD DISTRICT AS <br />WELL AS ALLOWING ALCOHOL SALES AT THE BILLIARD HALL <br />AND ALLOWING THE BILLIARD HALL TO REMAIN OPEN TO 4 <br />A.M. FOR COLISEUM BILLIARDS AT 2900 RICE STREET AS <br />REQUESTED BY BRIAN AND BRENDA MEYER SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />o COMPLIANCE WITH THE RECOMMENDATIONS <br />OF THE CITY PLANNER; <br />o 4 A.M. CLOSING TIME TO BE ALLOWED, WITH <br />CLOSING TIME TO BE POSTED AS 2 A.M.; <br />o ALCOHOL SALES AND CONSUMPTION TO BE <br />RESTRICTED TO THE BACK ROOM AREA AND <br />SALES TO CEASE AT 1 A.M.; <br />o THE CUP IS NON - TRANSFERABLE; <br />o A SATISFACTORY SIX -MONTH REVIEW OF THE <br />CUP. <br />2 <br />
