CITY OF LITTLE CANADA ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 301 OF THE LITTLE CANADA CITY CODE, KNOWN AS THE MUNICIPAL CODE, AS RELATES TO DRIVEWAYS AND ADOPTING CHAPTER 821 OF THE LITTLE CANADA CITY CODE, KNOWN AS THE MUNICIPAL CODE, ESTABLISHING DRIVEWAY PERMITS The City Council of the City of Little Canada hereby ordains: Section 1. Section 301.070. DRIVEWAYS. is hereby deleted in its entirety: - constructed of crushed rock, bituminous, cement, or concrete. The design of, and the materials used for, all driveways shall be in accordance with engineer standards prepared by the City Engineer and approved by the City Council for bituminous or concrete driveways only. Section 2. Chapter 821. DRIVEWAYS. is hereby established as follows: 821.010. PURPOSE AND INTENT. The purpose of this chapter is to control the location of curb cuts and driveways in order that traffic hazards are reduced, adequate street drainage is maintained, required setbacks are maintained, and ingress and egress from properties shall not constitute a hazard or impair the health, safety, or public welfare of the residents of the city. 821.020. PERMIT REQUIREMENTS. 821.020.A. Permit Required: No driveway shall be constructed, reconstructed, expanded, or altered at any location where motor vehicles will be provided with access to any public right -of -way without first obtaining a permit for said construction from the Building Official or designee. The Building Official or designee may add conditions to the permit. 821.020.B. Application: Any person desiring said permit shall present a written application to the Building Official or designee describing the improvements to be made and plans which indicate that the requirements of the City's Codes, as well as any applicable State Codes, will be met. 821.020.C. Permit Fees: Such application shall be accompanied by a fee in an amount set by the Council and kept on file in the City Administrator's office. 821.020.D. Revocation: The permit may be revoked by the Building Official or designee at any time after its issuance for failure to comply with the conditions of the permit respecting the work.
