CITY OF LITTLE CANADA <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING CHAPTER 301 OF THE LITTLE CANADA CITY CODE, <br />KNOWN AS THE MUNICIPAL CODE, AS RELATES TO DRIVEWAYS AND ADOPTING <br />CHAPTER 821 OF THE LITTLE CANADA CITY CODE, KNOWN AS THE MUNICIPAL <br />CODE, ESTABLISHING DRIVEWAY PERMITS <br />The City Council of the City of Little Canada hereby ordains: <br />Section 1. <br />Section 301.070. DRIVEWAYS. is hereby deleted in its entirety: <br />- <br />constructed of crushed rock, bituminous, cement, or concrete. The design of, and the <br />materials used for, all driveways shall be in accordance with engineer standards prepared <br />by the City Engineer and approved by the City Council for bituminous or concrete <br />driveways only. <br />Section 2. <br />Chapter 821. DRIVEWAYS. is hereby established as follows: <br />821.010. PURPOSE AND INTENT. The purpose of this chapter is to control the location <br />of curb cuts and driveways in order that traffic hazards are reduced, adequate street drainage is <br />maintained, required setbacks are maintained, and ingress and egress from properties shall not <br />constitute a hazard or impair the health, safety, or public welfare of the residents of the city. <br />821.020. PERMIT REQUIREMENTS. <br />821.020.A. Permit Required: No driveway shall be constructed, reconstructed, <br />expanded, or altered at any location where motor vehicles will be provided with access to any <br />public right -of -way without first obtaining a permit for said construction from the Building <br />Official or designee. The Building Official or designee may add conditions to the permit. <br />821.020.B. Application: Any person desiring said permit shall present a written <br />application to the Building Official or designee describing the improvements to be made and <br />plans which indicate that the requirements of the City's Codes, as well as any applicable State <br />Codes, will be met. <br />821.020.C. Permit Fees: Such application shall be accompanied by a fee in an amount <br />set by the Council and kept on file in the City Administrator's office. <br />821.020.D. Revocation: The permit may be revoked by the Building Official or <br />designee at any time after its issuance for failure to comply with the conditions of the permit <br />respecting the work. <br />
