MINUTES <br />PLANNING COMMISSION <br />JANUARY 12, 2006 <br />TEXT <br />AMENDMENT <br />& CUP FOR <br />RECREATIONAL <br />USE IN FRONT <br />YARD AS WELL <br />AS CUP FOR <br />TWO GARAGES <br />AND GARAGE <br />SPACE OVER <br />1,000 SQUARE <br />FEET — <br />2850 <br />EDGERTON <br />STREET — <br />MATT GALBA <br />and noted that reducing the front yard setback to 30 feet does not change the <br />setback from the lake. Knudsen pointed out that it has been typical to see <br />redevelopment of lake lots with larger homes. As long as the setback to the <br />lake is protected, he did not see a concern with reducing the front yard <br />setback. <br />Knudsen recommended approval of the Text Amendment to the Shoreland <br />District reducing the required front yard setback in the Single Family <br />Zoning District (R -1) to thirty (30) feet for properties abutting a Federal, <br />State, or County trunk highway. <br />Motion seconded by Barraclough. <br />Motion carried 7 — 0. <br />Mr. Matt Galba, 2850 Edgerton Street, appeared before the Commission <br />requesting approval of the following: <br />Text Amendment creating a Conditional Use Permit to allow for <br />recreation uses in the front yard; <br />Conditional Use Permit allowing a recreational use (sports court) <br />in the front yard; <br />Conditional Use Permit for two attached garages consisting of over <br />1,000 square feet in area. <br />Galba reviewed his plan for a sports court for hockey and basketball for the <br />use of his children and friends. Galba felt that this sports court was a good <br />solution to ensuring his children remain active and healthy as well as a <br />means to interact with friends. <br />Socha asked if Galba was aware that a permit would be needed for the <br />sports court prior to constructing it. Galba replied that he did not. He noted <br />that he has a very large lot, and felt that he needed to make use of his <br />property. Hall felt that in planning a sports court like this, it was Galba's <br />responsibility to first check into the permit process before constructing it. <br />Galba indicated that there is nothing in the City's Code that says a hockey <br />rink cannot be located in a front yard. Galba pointed out that the rink is <br />now up and stated that he was willing to work with the City to make the <br />rink acceptable. <br />Knudsen felt that debating the permitting process at this point was not in <br />anyone's best interest. Knudsen noted that, in this case, the size of the front <br />yard is unique. He also stated that he completely understands Galba's <br />desire to make use of his front yard. Knudsen felt that the City now has to <br />deal with what can happen in the City and what needs to happen. Knudsen <br />-4- <br />
