Hanson <br />The City Council has previously been provided with the background infoccnation on this issue. <br />Staff feels it is important to note that if you approve the text amendment to allow recreational <br />uses in the front yard, verification of setback compliance is necessary for the Galba's rink/sport <br />court. If one assumes Edgerton is centered within its 66 -foot right -of -way, then it appears the <br />rink is about 22 feet off of the property line. (Keep in mind that the paved portion of Edgerton <br />may not be centered within the right -of -way.) Therefore, the property owner would need to <br />locate existing survey monuments or survey the property in order that setback compliance can be <br />determined. If setbacks do not comply, then the sport court would need to be moved to achieve <br />compliance. <br />The other issue that will need resolution is the maximum impervious surface area. Mr. Galba has <br />indicated he will comply with this requirement. If the approval is granted, it should be subject to <br />the receipt of a plan indicating how compliance will be achieved. <br />cc: Matt Galba <br />
