structure. The court contains a ribbed surface for traction and an interlocking design to <br />allow for drainage. <br />Proposed text amendments have been included as follows: <br />Attachment 1: Front Yard Setback Amendment <br />Attachment 2: Creation of a Conditional Use Category for recreation <br />facilities <br />ANALYSIS <br />Required Setback. As stated above, swimming pools, tennis courts and other <br />recreational facilities are allowed in the R -1 District. These uses are allowed in the <br />required rear yard, but not in the front yard. The applicant is requesting that the City <br />create a conditional use category specifically for recreational facilities in a front yard, <br />other than a required yard. According to the site plan, the recreational structure is <br />proposed to be setback 30 feet from the property line. Section 917.030 of the code <br />states that the required setback from an abutting federal, state or county trunk highway <br />in the Shoreland District is 50 feet. The required setback from an abutting town road or <br />public street is 30 feet. Due to the proposed location of the structure, the applicant is <br />also requesting a text amendment to Section 917.030, changing the required front yard <br />setback in the Shoreland District from 50 feet to 30 feet. <br />The following definitions are found in Section 902 (A) (210): <br />Yard- Front. A yard extending across the front of the lot between the side lot lines and <br />lying between the front line of the lot and the nearest line of the building. <br />Required Yard. A portion of the front yard, side yards, or rear yard which is required by <br />setback standards. <br />City staff has previously indicated a willingness to recommend changes to the setback <br />requirement to be consistent with setback requirements in the R -1 District. The front <br />yard setback in the R -1 District is 30 feet. A text amendment to the required front yard <br />setback in the Shoreland District has been attached for review and is subject to further <br />modification by the City Council. <br />Placing the proposed recreational structure in the front yard of the property would <br />require an additional CUP for the structure to be located nearer the front lot line than the <br />principal structure. Section 903.020 D states that, except by CUP, no accessory <br />building or shed may be ! ocated closer to the front line of a lot than the rear building line <br />of the principal structure. The issuance of a conditional use permit for location in front of <br />the rear building line of the principal structure shall be considered to be a special <br />exception, conditioned upon factors including, but not limited to, the following: <br />♦ The accessory building or shed is screened from the view of the public street with <br />fencing and /or landscaping. <br />o The architectural appearance of the accessory building is reasonably coordinated <br />with the principal structure. <br />2 <br />
