The second text amendment would create a conditional use category for recreation <br />facilities in a front yard, rather than a required front yard in the R -1 District under <br />Section 905.040 D. Based on the above issues, staff recommends that the proposed <br />use be subject to the following conditions: <br />• The applicant does not exceed the maximum allowed impervious surface of 30% <br />in the Shoreland District <br />o The recreational facility is screened from the view of the public street and <br />neighboring residential properties with landscaping. Said landscaping must be <br />tall enough to screen the proposed 9 foot fence. <br />♦ The architectural appearance of the structure is reasonably coordinated with the <br />principal structure. <br />• Placement of the structure shall not detract from the appearance of the <br />streetscape and shall be consistent with the character of the neighborhood. <br />♦ The applicant comply with the following setback requirements: <br />Setback <br />Currently <br />Required <br />50 feet* <br />Proposed <br />Requirement <br />30 feet <br />Front Yard <br />Side Yard (interior lot line) <br />7.5 feet <br />15 feet <br />Side Yard (public right -of -way) <br />30 feet <br />30 feet <br />Rear Yard <br />30 feet <br />30 feet <br />*Currently 50 feet in Shoreland areas, 30 feet in R -1 District <br />♦ The total height of the fence used for enclosure of the structure not exceeds 10 <br />feet. <br />♦ A special classification is made for hockey boards not to be considered a fence. <br />♦ The recreational facility is limited to hours of operation as specified by the City <br />Council. <br />♦ The recreational facility complies with all regulations of the noise ordinance, as <br />specified in Section 2801.010. <br />• All lighting shall be arranged as to deflect light away from any adjoining <br />residential zone or from the public streets as specified in Section 903.020 H <br />• The applicant process a lot combination form with Ramsey County, as well as a <br />deed restriction, making this combination permanent. <br />SUMMARY AND RECOMMENDATION <br />The applicant has proposed that the City amend its Zoning Ordinance to establish a <br />Conditional Use Permit for recreational facilities in the front yard. Staff has developed <br />ordinance amendments that would: <br />1. Reduce the required front yard setback in the Shoreland area to 30 feet, <br />consistent with the R -1 zoning regulations. <br />6 <br />
