MINUTES <br />CITY COUNCIL <br />JANUARY 28, 2026 <br />CONSENT AGENDA <br />Miller introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2026-1-9 — APPROVING THE CONSENT AGENDA WHICH <br />CONTAINS THE FOLLOWING. - <br />Approval of the Vouchers <br />• Adopt: Resolution 2026-1-10 Approving Lupe Development Partners Redevelopment <br />Application to Minnesota Department of Employment and Economic Development and <br />Resolution 2026-1-11 Approving Commitment of the Local Match and Authorizing <br />Contract Execution for the 99 County Road B East Redevelopment Grant Application <br />• Approve Hire of Gina Brady as Recreation Coordinator <br />• Approve Agreement with Canadian Pacific KC Rail for Replacement of Little Canada <br />Road Railroad Crossing in 2026 <br />• Approve the 2025 Recreation Coordinator Services Contract with Twin Cities Officials <br />• Approve Quick -Take Payment for Little Canada Road Project Easement Acquisitions <br />• Approve Resolution 2026-1-12 Establishing Parking Restrictions on Little Canada Road <br />and Country Drive <br />• Approve Keyless Entry Expansion at City Hall and Old Fire Hall <br />The foregoing resolution was duly seconded by Kwapick. <br />Ayes (4). Nays (0). Resolution declared adopted. <br />STAFF REPORTS <br />ORDINANCE 929, AMENDING CITY CODE 802, TOBACCO PRODUCTS <br />The City Clerk stated that several changes have been made over the last eight years to the City Code <br />related to tobacco products. She commented that in 2022, changes were made that would sunset some <br />of the tobacco licenses and provided additional information on those licenses and that process. She <br />provided additional details on the change that was made previously to allow the ownership of a gas <br />station to change while allowing the continued sale of tobacco. She noted a similar instance that is <br />arising for a tobacco shop that is relocating in the community. She reviewed the proposed changes to <br />the ordinance, which would allow a license to be issued to the same business in a new owner/location. <br />She stated that new licenses still would not be allowed. <br />Mayor Fischer asked and received confirmation that this license could live in perpetuity. He asked if <br />the current owner could place a fee on the license and profit from it. He asked and received <br />confirmation that a transfer of the license would need to go before the Council for review and <br />approval. <br />Malone recognized that this is the only license of this type. <br />Mayor Fischer commented that this was a specific action of the Council to limit the sale of tobacco in <br />the community. <br />Miller used an example where the business closed and asked if the license would then be eliminated or <br />whether a change in the Code would be necessary. <br />0 <br />
