MINUTES <br />CITY COUNCIL <br />JANUARY 28, 2026 <br />Mayor Fischer commented that if the business closed, the license would be forfeited, and it would be <br />the decision of the Council as to what to do with the license. <br />John DeRosa, owner of Little Canada Smoke Shop, was present with his son Vinny DeRosa who has <br />managed the Smoke Shop for the last four years. He stated that as he moves forward with Feelin' <br />Minnesota and being busy with the activities of his family and children, he would like to transfer <br />ownership of the Smoke Shop to his son. <br />Malone introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2026-1-13 —ADOPTING ORDINANCE 929, AMENDING CITY <br />CODE CHAPTER 802, TO REDUCE THE NUMBER OF TOBACCO STORE LICENSES <br />ALL O WED, AND REMOVING THE TOBA CCO STORE LICENSING OWNERSHIP AND <br />L 0 CA TION RES TRICTIONS, AND APPROVING THE PUBLICATION OF SUMMARY <br />rolY <br />The foregoing resolution was duly seconded by Kwapick. <br />Ayes (4). Nays (0). Resolution declared adopted. <br />ADOPT UPDATED CITY COUNCIL CODE OF CONDUCT <br />The Assistant City Administrator provided background information on the creation of the Council <br />Code of Conduct and the annual process followed to reaffirm. She noted changes that were made to <br />the document to reflect updated policies and to include additional language recommended by the City <br />Attorney. She stated that a thorough review of the changes was conducted by the Council in a <br />previous workshop. <br />Mayor Fischer stated that the changes to open meeting laws allow a wide latitude for remote <br />attendance, and this Council agrees that it is best and most productive to attend in person, although <br />there may be times when people cannot attend in person. <br />Miller stated that he supports the changes recommended by the City Attorney. <br />Kwapick also agreed and noted that this helps to place boundaries on the role of the Council members. <br />Mayor Fischer introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2026-1-14 — APPROVING THE CITY COUNCIL CODE OF <br />COND UCT POLICY FOR CITY CO UNCIL MEMBERS <br />The foregoing resolution was duly seconded by Miller. <br />Ayes (4). Nays (0).
