The Preserve <br />Development Contract <br />time expended in conjunction with this Contract are expected to equal two and one half percent <br />(2.5 %) of the construction cost involved in the Contract. Said fee can be increased or reduced in <br />the sole discretion of the City, should staff time required vary dramatically from this estimate. <br />This provision is consistent with an agreement between the City and Developer, dated May 24, <br />2002, which is attached hereto and incorporated herein as Exhibit D. Said deposit is in addition <br />to any amounts due or owed pursuant the agreement referenced in Exhibit D. <br />Engineering <br />14. The Developer shall cause to be constructed, at its cost and its own risk, the <br />Grading and Drainage Improvements according to City standards. All of the Grading and <br />Drainage Improvements shall be approved by the City and shall be consistent with the approved <br />Final Plat and the Grading, Drainage, Erosion Control, and Landscaping Plans as revised and <br />dated January 17, 2006. A copy of said plans are attached hereto and incorporated herein as <br />Exhibit C. The Developer also agrees to adhere to all terms and conditions as set forth by the <br />Ramsey - Washington Metro Watershed District (RWMWD) Permit #05 -43, a copy of which is <br />attached hereto as Exhibit E. <br />15. Developer or their agents or assigns, shall comply with all provisions of the SWP <br />including but not limited to keeping the public streets clear of any soil, earth or debris resulting <br />from work done by Developer or their agents or assigns. Any such materials must be promptly <br />removed and in no event shall they be present more than 24 hours after placement. Failure to <br />comply with this provision will result in the City undertaking this work with costs to be <br />reimbursed by Developer pursuant to Paragraphs #'s 10 & 11. <br />16. The Developer shall cause to be performed to the City Engineer's satisfaction all <br />finish grading, and shall maintain said grading, until Certificates of Occupancy are issued for all <br />buildings within the Plat.
