Current Site Conditions <br /> <br /> <br />Feelin MN submitted a signed Letter of Intent to purchase the building with their application and has <br />subsequently submitted to Staff a formal purchase agreement. <br /> <br />Feelin MN intends to modify the floor plan of the existing office and operate the dispensary in the <br />existing building. The submitted floor plan includes a secured lobby and check-in area on the south <br />side of building, monitored by on-site security. The retail sales area would be located in the center of <br />the building. Product storage is proposed in converted offices on the building’s rear/north side. <br /> <br />The applicant has submitted both a security plan and a ventilation plan as required under City <br />ordinance. The layout and operational details are consistent with dispensary models reviewed in other <br />states. These plans are included for Commission review. <br /> <br />The site does have some legal non-conformities; however, the applicant is not proposing to alter them <br />in a way that would require them to be brought into full compliance with the City Code at this time. <br />The applicant intends to make minor exterior improvements to the site such as restriping and sealing <br />the parking lot and trimming vegetation around the site. <br /> <br />The legal non-conformities Staff have identified are the following: <br />1. The driveway setbacks on the property sides (east and west side) of building are currently about <br />0’ when 5’ is required <br />2. The applicant does not provide any bike parking when two spaces are required. <br />3. The property does not have the full number of plantings to screen the parking lot and is just shy <br />of the full 20’ buffer on the south/front facing Little Canada Road West <br />4. The property does not have a sidewalk that remains at-grade through the driveway curb cut nor <br />does it have a dedicated pedestrian path from the sidewalk to the building. These are recently <br />adopted requirements from the driveway ordinance. <br /> <br />The applicant and Staff have discussed the possibility of subdividing the parcel for the construction of <br />an additional building on the site in the future, allowing the applicant to consolidate his tobacco sales <br />business on the property but in a different structure. At the point of subdivision, or if the applicant <br />removes/reshapes the parking lot, the applicant would be required to bring the property into full <br />conformity these standards.
