3 <br /> <br />requiring that some or all these improvements to the site take place sooner, if they can establish a clear <br />relationship to such a condition and one of the IUP criteria. <br /> <br />OUTSIDE AGENCY REVIEW <br />The applicant is not proposing any substantive exterior modifications to the building, nor are there any <br />changes to site engineering, drainage, or natural features. The site is not located on a county road. As a <br />result, no outside agency review is required for this request. <br /> <br />PUBLIC COMMENT <br />Staff mailed public hearing notices to all property owners within 350 feet of the common interest <br />community boundary. Notice was also published in the Pioneer Press on Friday, September 5, 2025, in <br />accordance with statutory requirements. <br /> <br />City Staff have received no written public comments, and no comments were received at the Planning <br />Commission Meeting. <br /> <br />PLANNING COMMISSION <br />The Planning Commission heard the case at their September 11th regular meeting. The Planning <br />Commission unanimously recommended approval of the IUP with the 12 listed conditions. There were <br />discussions about potential site improvements that could occur now, but the Planning Commission did <br />not see a clear connection between landscaping and parking lot improvements with any of the standard <br />six IUP conditions. They did discuss asking the applicant to install bike parking, but ultimately decided <br />such a request should not be a formal condition of approval. <br /> <br />REQUEST <br />The applicant is requesting an Interim Use Permit (IUP) to operate a retail cannabis dispensary at 75 <br />Little Canada Road W. <br /> <br />What is an IUP? <br />An Interim Use Permit is a zoning tool used by the City to allow certain uses that may be appropriate <br />in a district, but which could pose impacts if not properly conditioned. Interim Uses are similar to <br />Conditional Uses, with the key distinction being that Conditional Use Permits run with the land <br />indefinitely, while Interim Use Permits are temporary and may include expiration dates or specific <br />conditions for termination. <br />The City of Little Canada evaluates Interim Use Permits based on two primary criteria: <br />1. The general review standards for all interim and conditional uses, as outlined in Section <br />917.070 of the Zoning Code; and <br />2. The Specific Development Requirements applicable to the proposed use, as established in <br />Chapter 914. <br /> <br />Approval Criteria <br />Under Minnesota law and City Code, Interim Use Permits are presumed to be allowed when the <br />applicant meets the applicable zoning standards. The burden is on the City to identify factual evidence <br />in the record if it finds that the proposed use does not meet one or more of the required criteria. <br /> <br />To approve an Interim Use Permit, the City must find that the following conditions are met: <br />1. The use is allowed as a Conditional or Interim Use in the zoning district and conforms to <br />standard zoning regulations;
