4 <br /> <br />2. The Conditional or Interim Use will conform to the conditions listed in Chapter 914 for the <br />proposed use; <br />3. The Conditional or Interim Use will not impede the normal and orderly use or development of <br />nearby property, substantially diminish nearby property values or place an undue burden on <br />public facilities or services; <br />4. The Conditional or Interim Use will not be detrimental to the health, safety, or welfare of the <br />public; <br />5. The Conditional or Interim Use will not result in a nuisance by emissions; <br />6. The Conditional or Interim Use will not unduly affect natural features. <br /> <br />If the Planning Commission or City Council determines that the use would fail to meet one or more of <br />these standards, such a finding must be supported by evidence in the public record. <br /> <br />The applicant has submitted all required materials for review, including a project narrative, a site- <br />specific security plan, and a ventilation plan, in accordance with City requirements for cannabis retail <br />uses. <br /> <br />Applicant Narrative <br />The applicant has submitted a project narrative, security plan, and ventilation plan as required under <br />the City’s cannabis regulations. In the narrative, Mr. DeRosa outlines his prior experience as a business <br />owner in Little Canada and provides a general overview of the proposed improvements to the site. He <br />describes the use of commercial air purifiers and a self-contained HVAC system to mitigate odor, and <br />details the facility’s planned security measures, including restricted access, product storage protocols, <br />and on-site monitoring consistent with OCM’s rules for operation. <br /> <br />Staff Findings <br />Staff support the applicant’s Interim Use Permit request and find that it meets all required conditions <br />for approval. This review is based on the specifics of the site, the proposed use, and compliance with <br />City ordinances. Cannabis retail is legal under Minnesota law, and the City’s role is to evaluate the <br />proposal against its zoning and development standards. <br /> <br />1. The use is allowed as a Conditional or Interim Use in the zoning district and conforms <br />to standard zoning regulations. <br />Retail cannabis uses are permitted in the C-2, Corridor Mixed District, provided they are not co- <br />located with residential units.
