34851-40071/3659883/3 <br /> <br /> <br />THIRTY-SIXTH RIDER TO AGREEMENT <br /> <br /> <br />THIS RIDER TO AGREEMENT, made this 12th day of November, 2025, by and <br />between the <br /> <br />BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL (“Board”), <br /> <br />and the CITY OF LITTLE CANADA, County of Ramsey, State of Minnesota, (“City”), being <br />the Thirty-Sixth Rider to that certain Agreement made by and between the Board and the City the <br />13th day of July, 1966, and by this reference incorporated herein and made part hereof and with <br />the same intent, purpose, and effect as if said Agreement were set forth herein verbatim. <br />WHEREAS, the Board is the owner of a 110 foot wide easement right-of-way located in <br />the N half (N ½) of the SE quarter (SE ¼) of Section 6, Township 29 North, Range 22 West, in <br />the city of Little Canada, Ramsey County (the “Premises”); and <br />WHEREAS, the City desires to enter upon certain portions of the Premises to install a <br />stormwater filtration basin and storm sewer that encompasses portions of the Premises; and <br />WHEREAS, the Board is willing to grant said permission to the City, given that any work <br />performed by the City is consistent with the requirements and safety standards used by the <br />Board in similar projects. <br />NOW, THEREFORE, BE IT AGREED, in consideration of the mutual promises and <br />agreements of the parties hereto, subject to all terms and conditions contained in said Agreement <br />between the parties hereto made and entered into the 13th day of July 1966, the Board hereby <br />grants to the City permission to enter upon portions of the Premises for the purposes of
