4. All signing and informational or visual communication devices shall be in <br />compliance with Section 903.110 of this Ordinance. <br />5. The provisions of Section 921.010.0 of this Ordinance are satisfactorily met. <br />6. The regulations and conditions of the Minnesota Department of Public Welfare, <br />Public Welfare Manual 11 3130 as adopted, amended and /or changed are <br />satisfactorily met. <br />7. A written indication of preliminary, pending or final license approval from the <br />regulatory welfare agency is supplied to the City. <br />Section 921.010.0 referenced above includes the following criteria: <br />a. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Land Use Plan. <br />b. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future land uses of the <br />area. <br />c. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained herein. <br />d. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use will not tend to or actually depreciate the aggregate property <br />values in the area in which the amendment or conditional use is proposed. <br />e. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />f. The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character of the <br />conforming buildings in the surrounding area in regard to the following: <br />a. Proportion, scale and roof line; <br />b. Architectural style; and <br />c. Exterior finish materials. <br />Comprehensive Plan. As noted above, a determination should be made that the <br />proposed use has been considered in relation to the specific policies and provisions of <br />and has been found to be consistent with the official City Comprehensive Land Use <br />Plan. <br />2 <br />
