<br />Proposed Ordinance: <br />Ordinance 921 makes minor amendments to the existing standards outlined in Chapters 2202 and <br />2203. <br /> <br />1. It separates massage as a practice from other touch-based complementary and alternative <br />health care practices, definitionally. The City currently defines massage establishments <br />narrowly, and the proposed ordinance, rather than broadening the definition of massage, <br />creates another category for other touch-based CAHC practices. <br /> <br />2. The regulations require massage-specific educational requirements. The proposed <br />ordinance would exempt non-massage CAHC practitioners from the educational <br />requirements. <br /> <br />3. Establish a license cap of three (3) non-massage touch-based complementary and <br />alternative health care practitioners in the City, mirroring the existing cap for massage <br />businesses. <br /> <br />4. Require touch-based CAHC practices to follow the same performance standards currently <br />in place for massage establishments: <br />a. The license from the City must be displayed; <br /> <br />b. The operator must provide correct identification if requested by a police officer; <br /> <br />c. The establishment must be open to inspection by the building and license <br />inspectors, health officers, and police officers during business hours; <br /> <br />d. The license is only valid for the approved location and must notify the City if the <br />location of the establishment is to change/move; <br /> <br />e. Hours of operation are restricted to be from 8:00 AM to 9:00 PM; <br /> <br />f. No drugs or alcohol are permitted on the premises; <br /> <br />g. Any violations of any law or regulation relating to building, safety or health, shall <br />be grounds for revocation of the license; <br /> <br />h. There shall be no locks on doors to practice rooms; and <br /> <br />i. The patron/provider and any customer/client shall have their breasts, buttocks, <br />and genitals covered by non-transparent material (clothes, towels, etc.) at all <br />times. <br /> <br />5. Add an additional performance requirement to the existing list: <br />“No part of the licensed premises shall be used for or connected with any bedroom or <br />sleeping quarters. No person shall sleep within the licensed premises except for a limited <br />period incidental to and directly related to the provision of massage therapy or
