<br /> 2202-5 <br />4. Review of application. License applications shall be reviewed by the City <br />Administrator, and the Sheriff's Department may run criminal history checks on applicants. <br /> <br />5. Denial of application. The license application may be denied for any of the following <br />reasons: <br /> <br />a. The application contains false, fraudulent, or deceptive statements. <br /> <br />b. The applicant has been convicted of or entered a plea of guilty within the <br />previous three (3) years to a violation of this chapter or of any other law <br />regulating the practice of massage, or of any law prohibiting criminal sexual <br />conduct, prostitution, pandering, indecent conduct or keeping of disorderly <br />house. <br /> <br />c. The applicant has not complied with a provision of this ordinance. <br /> <br />d. The applicant is less than eighteen (18) years of age. <br /> <br /> 6. A license to provide massage therapy or complementary and alternative health care <br />practices shall be reviewed annually. No license approved by the City grants the licensee a property <br />right or entitlement to a license. The City Council may refuse to issue, refuse to renew, or may <br />suspend or revoke a license for any reason, and the City will not incur liability for any damages <br />including, but not limited to, direct, consequential, or incidental damages, deprivation of property, <br />loss of income, loss of profits, or loss of livelihood. <br /> <br />2202.050. REVOCATION OR SUSPENSION OF LICENSE. A license may be revoked or <br />suspended for any of the following reasons: <br /> <br />1. Fraud, deception or misrepresentation in connection with the registration application. <br /> <br />2. A violation of any provision of this chapter. <br /> <br />3. Conviction of a criminal sexual conduct, prostitution, pandering, indecent conduct, or <br />keeping a disorderly house. <br /> <br />4. Conviction of any crime or ordinance violation arising out of the practice of massage <br />therapy. <br /> <br />5. Exhibition of a demonstrable lack of skill in the practice of massage therapy. <br /> <br />6. A licensee’s engagement in any conduct prohibited under Minnesota Statutes, <br />Chapter 146A.08, shall constitute a violation of this Chapter and grounds for suspension or <br />revocation, irrespective of whether the practitioner claims exemption from or non-applicability of <br />Chapter 146A. <br />
