4 <br />7. Definitions and Interpretations <br />The amendments introduce a definition for “Building Footprint” and clarify setback <br />measurements to resolve internal inconsistencies. <br /> <br />Additional definitions for terms such as deck, patio, and ADU have been added to improve <br />usability and enforcement. <br /> <br />Planning Commission <br />The Planning Commission discussed the proposed ordinance updates at its September 11 meeting and <br />provided detailed direction to staff on specific standards. Staff returned with complete draft ordinances <br />on October 23, which the Commission unanimously recommended for approval (7-0). <br /> <br />The Commission’s discussion focused on several key policy areas: <br />1. Owner Occupancy for ADUs. <br />At its September meeting, the Commission initially supported requiring owner occupancy for <br />ADUs. After reviewing draft language in October, Commissioners reached consensus to <br />remove this requirement. They cited enforcement challenges, potential incentives for residents <br />to avoid rental registration, and the unfair favoritism such a provision would show toward <br />homeowners over renters. Commissioners also discussed practical cases, such as family <br />occupancy or temporary relocations, where an owner-occupancy rule would create unintended <br />barriers. <br /> <br />2. Detached Accessory Buildings. <br />The Commission directed staff to maintain existing limits in the R-1 District of up to three <br />detached accessory buildings with a combined maximum area of 1,500 square feet, while <br />clarifying that attached garages no longer count toward this total. <br />For multifamily and Common Interest Community (CIC) properties, Commissioners supported <br />removing rigid numerical limits and instead applying site plan review to any proposed <br />accessory structures to support reinvestment and replacement of older, non-conforming <br />garages. <br />For commercial and industrial properties, the Commission recommended aligning with peer <br />communities by allowing one detached accessory building, not exceeding 30 percent of the <br />principal building’s size.. <br /> <br />3. Conditional Use Permits <br />The Commission also provided direction to Staff to create clear and consistent standards for <br />accessory structures requiring a Conditional Use Permit, focusing on measurable criteria such <br />as building size, location, and visual compatibility. <br /> <br />Summary/Staff Analysis <br />Staff find that the proposed amendments meet all three criteria for zoning text amendments outlined in <br />Chapter 917 of the Zoning Ordinance. <br />
