MINUTES <br />CITY COUNCIL <br />MARCH 29, 2012 <br />County Road B -2 into this blacktopped turn - around area. They have also <br />relocated their trash collection into this area. Ankrum reported that, as a <br />result, the Dianna Lane properties backing up to this area are getting noise <br />from garbage trucks. He indicated that one of the County Road B -2 <br />properties is a rental, and there is a lot of traffic in and out of this shared <br />driveway. <br />Mrs. Ankrum reported that until recently when they walked to the back of <br />their lot, they were not aware of the installation of the blacktop onto their <br />property. Ankrum reported that she called the Building Official about the <br />encroachment who suggested that she obtain legal counsel. Ankrum <br />reported that they were reluctant to get an attorney at this point, but would <br />like to know the process that the City would be undertaking in conducting <br />the feasibility report. The Ankrum's expressed concern about a portion of <br />their property, and their neighbor's, being taken from them. <br />Montour noted that this issue will be addressed as part of the feasibility <br />study. Keis indicated that all impacted property owners would be kept <br />informed during the process. The City Engineer indicated that it will <br />likely be necessary to survey the area to establish property locations and <br />determine whether or not it will be feasible to put in a public street to <br />serve the four County Road B -2 properties. The City Engineer indicated <br />that the neighboring property owners will be included in this process. The <br />Engineer noted that accepting the petition and ordering the feasibility <br />report is the first step in the process. <br />Mrs. Ankrum noted the significant erosion of the back of their property <br />given that a portion of their woods was taken down. She asked if she and <br />her husband should have their property surveyed. McGraw noted that <br />both the issue of compensation for the right -of -way and the issue of <br />encroachment onto neighboring properties will be reviewed as part of the <br />feasibility study. <br />Mrs. Ankrum reported that initially there was a small driveway to serve <br />one home on County Road B -2. Ankrum indicated that the situation is <br />significantly different in terms of privacy given the driveway serves four <br />homes and a turn - around has been added. Ankrum was concerned about <br />the process and asked to be included in it. The City Planner assured the <br />Ankrum's that any impacted property owners would be included in the <br />process. <br />Mrs. Ankrum asked about the encroachment issue. The City Planner that <br />the encroachment of the asphalt on the Dianna Lane properties is a private <br />issue between property owners. However, given the petition for a public <br />road improvement, that issue can be addressed as part of the process. The <br />10 <br />
