MINUTES <br />CITY COUNCIL <br />MARCH 29, 2012 <br />ACCEPT <br />PETITION <br />& ORDER <br />FEASIBILITY <br />REPORT — <br />ACCESS TO <br />735, 739, <br />743, AND 751 <br />COUNTY <br />ROAD B -2 EAST <br />The property owner at 2590 Park Street asked the estimated life of the <br />street, once improved, as well as how often the street would require seal <br />coating. The Engineer estimated the life at 15 to 20 years with seal <br />coating to occur on a 7 year cycle. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -3 -55 — AWARDING THE LOW BID OF T. A. <br />SCHIFSKYIN THE AMOUNT OF $402,583.93 FOR 2012 <br />IMPROVEMENTS AS WELL AS REHABILITATION OF THE OLD <br />FIRE HALL PARKING LOT AND EAST SPOONER PARK PARKING <br />LOT <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Clerk reported that the City is in receipt of petitions from the <br />property owners at 735, 739, 743, and 751 County Road B -2 East <br />requesting improvement of the road access to their properties. While <br />all four of the impacted property owners have submitted a petition, the <br />property owner at 743 County Road B -2 East is asking to be compensated <br />for this potential road right -of -way. The Clerk indicated that this is an <br />issue which will need to be resolved between the four property owners. <br />Another issue that needs resolution is the possibility that the current <br />driveway location encroaches onto neighboring property. The Clerk <br />reported that factoring out the petition submitted by the property owner at <br />743 County Road B -2, there are more than the minimum number of <br />signatures required to proceed with a feasibility report, 35% of the <br />impacted property owners being the minimum. Therefore, staff <br />recommends acceptance of the petitions and ordering the feasibility report. <br />Again, the Clerk indicated that the issues of right -of -way compensation <br />and encroachment will be addressed in the feasibility report process. <br />Dan Ankrum, 2409 Dianna Lane, reported that when he first purchased his <br />property on Dianna Lane, the rear yard was heavily wooded. Many of <br />these trees have died because one of the owners of the County Road B -2 <br />properties being discussed placed blacktop on the back of 2409 Dianna <br />Lane and 2913 Dianna Lane. Ankrum reviewed a map of the area <br />showing where the encroachment is occurring and noted that his <br />neighbor's property stake is a couple of feet into the blacktopped driveway <br />area. Ankrum reported that, over the years, the property owners at 735, <br />739, 743, and 751 County Road B -2 have moved their mailboxes from <br />9 <br />
