03/15/05 [REVISOR ] JSK /MD A05 -0281 1 Subd. 33. [RAFFLE.] "Raffle" means a game in which a 2 participant buys a ticket far- a- ehanee -at -a -prize -with -the 3 winner- determined -bp -a- tandem - drawing -te- take - piece -at -a 4 iecatien- and - date - printed -open- the- tieket or other certificate 5 of participation in an event where the prize determination is 6 based on a method of random selection and all entries have an 7 equal chance of selection. The ticket or certificate of 8 participation must include the location, date, and time of the 9 selection of the winning entries. 10 [EFFECTIVE DATE.] This section is effective the day 11 following final enactment. 12 Sec. 5. Minnesota Statutes 2004, section 349.15, 13 subdivision 1, is amended to read: 14 Subdivision 1. [EXPENDITURE RESTRICTIONS.] Gross profits 15 from lawful gambling may be expended only for lawful purposes or 16 allowable expenses as authorized by the membership of the 17 conducting organization at a monthly meeting of the 18 organization's membership. Provided that no more than 70 19 percent of the gross profit less the tax imposed under section 20 297E.02, subdivision 1, from bingo, and no more than 55 60 21 percent of the gross profit from other forms of lawful gambling, 22 may be expended biennially-during the term of the license for 23 allowable expenses related to lawful gambling. 24 [EFFECTIVE DATE.] This section is effective for licenses 25 issued after June 30, 2006. 26 Sec. 6. Minnesota Statutes 2004, section 349.151, 27 subdivision 4, is amended to read: 28 Subd. 4. [POWERS AND DUTIES.] (a) The board has the 29 following powers and duties: 30 (1) to regulate lawful gambling to ensure it is conducted 31 in the public interest; 32 (2) to issue licenses to organizations, distributors, 33 distributor salespersons, bingo- he ±is; manufacturers, linked 34 bingo game providers, and gambling managers; 35 (3) to collect and deposit license, permit, and 36 registration fees due under this chapter;
