Exhibit B <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: October 22, 2004 <br />RE: Right -of -Way Acquisition from 2883 Condit <br />The attorney for the David and Theresa Miller has indicated acceptance of our earlier offer for the <br />acquisition of right -of -way for Nadeau Road and Condit Street. Mr. Kueppers letter indicates a purchase <br />price of $34,890 plus $1,500 for appraisal fee reimbursement that equates to the total of $36,390 I had in <br />my September 31 memo. (See letter from Joseph Kueppers and my memo of September 3rd attached.) <br />I had also recommended terms very similar to item #'s 2 -5. <br />Staff would recommend we finalize the acquisition of the Nadeau Road and Condit Street right -of -way <br />from the Miller's as outlined in Mr. Kueppers' letter of October 22, 2004 subject to the following: <br />1. Obtaining a quit claim deed from Masterpiece Homes, Inc. for the cartway as outlined in <br />Provision #3. <br />2. Reimbursement for power line relocation will be made only as a result of said relocation <br />being required due to the improvement of Nadeau Road /Condit Street /Hidden Acres and not <br />as the result of the property owner's discretion. <br />It should be noted that we have not yet incurred any appraisal costs as the appraiser was waiting for the <br />feasibility study for Condit Street. We also will not be able to fully complete Nadeau Road this fall. <br />However, we are hopeful that water and sewer could be installed to get the benefit of the freeze /thaw <br />cycle for settlement. <br />Assuming the City Council approves this acquisition, staff will continue to work on the other two <br />acquisitions needed along Condit. <br />cc: Joe Kueppers <br />
