6) The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character of the <br />buildings in the surrounding area in regard to the following: <br />a. Proportion, scale and roof line, <br />b. Architectural style; and <br />c. Exterior finish materials. <br />Co- Location. Co- location is considered positive by making more efficient use of the <br />existing towers and avoiding possible adverse impacts. According to the 1996 <br />Telecommunications Act, cities must "reasonably" accommodate communication <br />facilities such as that being proposed by Cingular Wireless. This issue will be subject to <br />forthcoming comment by the City Attorney. <br />If the City feels the construction of a new tower is justified, it should be constructed in a <br />manner conducive to future co- location of antennas by other uses (i.e. police, fire, other <br />cellular companies, etc.) <br />Land Use Compatibility. The subject site is zoned Industrial Park and is surrounding <br />by industrial uses. There does not appear to be any conflict with adjacent residential <br />properties or highly trafficked roadways. <br />Setbacks. According to Zoning Ordinance, setbacks for new towers must be equal in <br />height of the tower, including any antenna attachments or equal to the specific "fall <br />zone" of the proposed tower as determined and certified by a qualified and licensed <br />professional engineer, but in no event less than the principal structure setback of the <br />base zoning district from all public right of way and abutting property lines. As shown <br />on the submitted site plan, the tower is to be set back 15' from the existing building to <br />the northeast, 192' to the western property edge at Spruce Street, 100' to the southern <br />property edge, and 244' to the eastern property edge. <br />If the tower is to remain 15' from the existing building to the northeast, an engineering <br />statement must be provided to the City, identifying smaller fall zone or a "collapsible" <br />design. <br />Site Access. As shown on the proposed site plan, the proposed tower is to be <br />accessed via a 20 foot wide easement from Spruce Street. Issues relating to easement <br />acceptability should be subject to comment and recommendation by the City Engineer <br />and attorney. <br />Equipment Building. As noted previously, a 240 square foot (12 feet by 20 feet) <br />equipment building has been proposed in conjunction with the tower construction. As a <br />condition of CUP approval, such structure must satisfy applicable building material <br />requirements of Section 918.060.A -D. of the Zoning Ordinance. <br />Signage. Considering the proposed support structure's height and proximity to <br />Interstates 694 and 35E, such tower may provide an opportunity for advertising. As a <br />condition of CUP approval, no advertising messages may be affixed to the antenna <br />structure. <br />3 <br />
