A last point of consideration centers around the discussion at the Planning Commission <br />meeting about the MnDot tower located at the intersection of 694 and Rice Street. While I <br />understand the tower is MnDot's, the site is owned by Ramsey County. Therefore, the <br />concern about dealing with the State is not valid given their tower is inadequate to meet <br />Cingular's needs. If a new tower were to be considered, Cingular would need to deal with <br />Ramsey County. <br />Based on all of the above information, I am recommending we ask for additional information <br />to verify the need for this tower prior to acting on this request. The specific pieces of <br />information we should receive include, but may not be limited to the following: <br />• A map of all tower locations in Little Canada as well as those within at least a / mile <br />of our boundaries. <br />• Cingular's plans (including maps) for consolidating towers in our area to ensure this <br />tower is not being constructed due to their inability to renegotiate better terms on an <br />existing tower. <br />• Appropriate engineering documentation that can prove, in laymen's terms and with <br />verifiable data that this tower is truly needed. <br />• Appropriate engineering documentation that proves the existing tower on the Donovan <br />Construction site is not capable of serving Cingular's needs. Also to be included in <br />this documentation are the enhancements necessary to make the Donovan <br />Construction tower appropriate for this use. <br />Finally, this application was received on April 1 1`1'. Therefore, we need to be cognizant of the <br />60 day rule in considering this matter. It may be appropriate to ask Mr. Holm for a waiver of <br />this rule to ensure there is adequate time to produce and evaluate the requested information. <br />The City Attorney should also comment as to any concerns he may have with this approach. <br />cc: Tom Sweeney, City Attorney <br />Mark Holm, American Tower Corporation <br />
