Hanson <br />www.ci.little-eanacla.mn.us <br />MEMORANDUM <br />TO: Mayor Blesener & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: December 9, 2005 <br />RE: ISD #623 False Alarm Appeal <br />Attached is a letter from Mr. Len Copt of Roseville Area Schools requesting we abate $1,000 in <br />false alarm fines for 2005. These were fire false alarms. The fee schedule is as follows: <br />First two <br />Next four <br />Greater than six <br />- No Charge <br />- $250 each <br />- $500 each <br />The School District has paid $1000 in fees so far in 2005. This is the most false alarms they <br />have had in the last three years. (4 in 2003 and 2 in 2004) <br />The provision for the appeal of a false alarm is as follows: <br />816.60. APPEAL. User fees which have been appealed shall initially be reviewed by the City <br />Administrator or his /her designee. Should the appellant not agree with the decision rendered <br />by the City Administrator, the appeal shall be reviewed by the City Council. The alarm user <br />shall be invited to appear before the City Council. If the alarm user is not present when the <br />Council reviews the appeal, the City Administrator or his /her designee shall notify the alarm <br />user by regular mail, with affidavit of mailing, of the result of the Council's review. User <br />fees, as determined by the City Council, shall be paid within fifteen (15) days of the date of <br />mailing of the City's notice of the Council's decision. (The entire code is attached.) <br />While it appears the School District has experienced some extenuating circumstances and they have not <br />previously appealed any alarm charges, a strict reading of the ordinance does not provide for staff <br />abatement. <br />If the Council is inclined to grant the abatement, staff would suggest it be conditioned upon the school <br />district cooperating with the vacation of Park Street as previously discussed, including the moving of the <br />fence. Further, staff would recommend the fence along the vacated Park Street right -of -way have no <br />openings in order to discourage parking in that area. <br />Staff will discuss this issue with Mr. Copt prior to Wednesday's meeting to get his reaction. <br />cc: Len Copt <br />
