RECOMMENDATION <br />Prior to granting the Conditional Use Permit and Text Amendment to allow tattoo parlors <br />within the B -3 District, the City should first determine if the proposed tattoo parlor <br />requires a license agreement. With regards to the license agreement the following <br />options exist: <br />1. Direct staff to prepare a license agreement and present the agreement to the City <br />Council. <br />2. Continue the public hearing and direct staff to prepare a license agreement. A 60- <br />day extension letter would be required to ensure that the application is continued in <br />accordance with State Statutes. <br />3. No license agreement is necessary as the conditions related to health, safety and <br />general welfare shall be addressed within the Conditional Use Permit. <br />With regard to the Text Amendment the following options are proposed for <br />consideration: <br />Option 1. Approval of the Text Amendment to allow Tattoo Parlors by Conditional Use <br />Permit within the B -3 District. <br />Option 2. Denial of the Text Amendment to allow Tattoo Parlors by Conditional Use <br />Permit within the B -3 District with the finding that proposed tattoo parlor is not in <br />keeping with the uses or intent of the District. <br />With regard to the Conditional Use Permit the following options are proposed for <br />consideration: <br />Option 1. Approval of the Conditional Use Permit subject to the following conditions: <br />1. Approval of the Conditional Use Permit shall not constitute approval of the <br />building permit. <br />2. The applicant will be required to provide to the City a site plan, floor area, and <br />parking calculations. <br />3. Building materials and a sign plan shall be required. <br />4. No other related use shall be allowed or conducted on the property. <br />5. The applicant shall be solely responsible for the conduct of the business being <br />operated and shall at all times maintain conditions of order. <br />4 <br />7 <br />
